Terms of service

This is a first draft based on common practice in the UK/NZ fashion e-commerce sector. It has not been reviewed by a solicitor. Sections in [square brackets] need your input before this goes live, and we'd strongly recommend a qualified legal review before publishing — especially given cross-border sales to NZ and any future EU/US expansion.
1. Who We Are
This website (amalilondon.com, or your live domain) is operated by Amali London Ltd ("Amali London", "we", "us", "our"), a company registered in England and Wales under company number 17200096, whose registered office is at 21 Ruston Mews, London W11 1RB, UK.

By accessing this website or placing an order, you agree to be bound by these Terms and Conditions ("Terms"), together with our Privacy Policy and any other policies referenced here (Shipping Policy, Returns Policy, etc.). If you do not agree, please do not use the site or place an order.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order with us. By placing an order you confirm you are legally capable of entering into a binding contract.
3. Our Products
- We aim to describe and photograph our silk garments as accurately as possible, but colours may vary slightly depending on your screen settings, and natural fibres like silk can show minor variation between pieces.
- We are a small, growing brand and may limit order quantities, or refuse or cancel an order, at our reasonable discretion (for example, suspected fraud, pricing errors, or a product being incorrectly listed as in stock).
- Prices are shown in the currency of the store region you are browsing in ([GBP for the UK, NZD for New Zealand, AUD for Australia]) and are subject to change without notice. The price charged is the price displayed at checkout at the time you place your order.
4. Made-to-Order and Pre-Order Items
Some or all of our products are made to order or offered on a pre-order basis, with an estimated production and delivery lead time of approximately 6 weeks from order confirmation, as stated on the product page at the time of purchase.
- Estimated lead times are indicative and not guaranteed; we will notify you if a significant delay arises.
- Placing a pre-order does not guarantee stock availability of components (e.g. matching separates sold as part of a set) beyond the quantities confirmed at checkout.
- This does not affect your right to cancel under Section 7 below. Even though an item is made to order, if it is a standard (non-personalised) product, you still have the right to cancel within the statutory cooling-off period — see Section 7.
- If an item is genuinely bespoke or personalised to your specification (e.g. custom embroidery, monogramming, made to your individual measurements), the right to cancel under Section 7 may not apply. We will make this clear on the relevant product page.
5. Orders and Contract Formation
- Adding an item to your basket does not reserve it — stock is only allocated once payment is confirmed.
- Your order is an offer to buy. We will send an order confirmation email, but this confirms receipt of your order, not our acceptance. The contract between us is only formed when we send you a dispatch confirmation (or, for pre-order items, a production confirmation) email.
- We reserve the right to decline or cancel an order before that point — for example, if an item is unexpectedly out of stock, there was a pricing or listing error, or we suspect fraudulent activity. If we cancel your order, you will receive a full refund.
6. Payment
- Payment is taken via the methods offered at checkout (processed securely by Shopify Payments and/or other listed providers). We do not store your full card details.
- For pre-order/made-to-order items, payment is taken in full at the time of order unless otherwise stated at checkout.
7. Your Right to Cancel (UK & EU Customers)
If you are a consumer ordering from the UK, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order for a full refund within 14 days of receiving your goods, without giving a reason (subject to the exclusions in Section 4 for genuinely bespoke items).
- To cancel, contact us at info@amalilondon.com before the 14-day period expires.
- Goods must be returned unused, unworn, with tags attached, and in their original packaging where possible, within 14 days of telling us you wish to cancel.
- We will refund you within 14 days of receiving the goods back, using the original payment method. Original delivery charges are refundable; you are responsible for the cost of returning the item unless it is faulty.
This section applies specifically to UK/EU consumer contracts. For our general (non-statutory) exchange and returns approach for all customers, see our separate Returns Policy.
8. New Zealand Customers — Consumer Guarantees Act 1993
If you are ordering from New Zealand, nothing in these Terms affects your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which cannot be excluded. Under the CGA, our products come with guarantees that cannot be excluded, including that they are of acceptable quality, fit for purpose, and match their description.
If a product you receive is faulty or not as described, contact us at info@amalilondon.com and we will, as appropriate:
- repair it free of charge;
- replace it with an identical or comparable item; or
- provide a full refund,
within a reasonable time.
9. Faulty, Damaged or Incorrect Items
Regardless of location, if you receive an item that is faulty, damaged in transit, or not what you ordered, please contact us within a reasonable time at info@amalilondon.com with your order number and photos where possible. We will arrange a repair, replacement, or refund as appropriate — this is in addition to, and does not affect, your statutory rights under Sections 7 and 8.
10. Shipping and International Orders
- We currently ship to the United Kingdom and New Zealand[, and other destinations as listed at checkout].
- Estimated delivery times are shown at checkout and on our Shipping Policy page and exclude the production lead time described in Section 4 for made-to-order items.
- Customs, duties and import taxes: for orders shipped to New Zealand (or any destination outside the UK), you are responsible for any customs duties, import VAT/GST, or other charges levied by the destination country. These are not included in our prices or shipping charges and are outside our control. We recommend checking with your local customs authority before ordering.
- Risk in the goods passes to you once the item is delivered to the address you provided.
11. Product Care
Our garments are made from silk and other delicate fabrics. Please follow the care instructions on the garment label. We are not responsible for damage caused by failure to follow care instructions, normal wear and tear, or improper washing/dry cleaning.
12. Intellectual Property
All content on this site — including product designs, photography, text, logos, and the Amali London name and branding — is owned by or licensed to Amali London Ltd and protected by copyright, trade mark and other intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written consent.
13. User-Generated Content ("Styled By You" and Social Media)
If you tag us or use our hashtag on Instagram or other social platforms, or otherwise submit photos, reviews, or comments to us, you agree that:
- you own the content or have permission to share it;
- you grant Amali London Ltd a non-exclusive, worldwide, royalty-free licence to display, reproduce, and share that content on our website (including in features such as our "Styled By You" gallery), social media, and marketing materials, with credit to you where reasonably possible;
- this content must not be unlawful, offensive, or infringe anyone else's rights;
- you can ask us to remove your content from our site at any time by contacting info@amalilondon.com, though we cannot guarantee removal from social platforms outside our control.
14. Third-Party Tools and Services
Our site may use third-party apps and tools (for example, product add-on or inventory tools) to enhance functionality. We do not control these third-party services and are not liable for their availability, accuracy, or performance. Your use of any such tool is at your own discretion.
15. Prohibited Use
You agree not to use this site to: break any applicable law; transmit viruses or harmful code; infringe our or anyone else's intellectual property rights; harass or discriminate against others; submit false information; or interfere with the security or functioning of the site.
16. Disclaimer and Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded (including your statutory rights under Sections 7 and 8).
Subject to that, to the fullest extent permitted by law:
- the site and its content are provided "as is" without warranties of any kind beyond those required by law;
- we are not liable for indirect or consequential losses (such as loss of profit or business opportunity) arising from your use of the site or products; and
- our total liability to you in connection with an order is limited to the price you paid for that order.
17. Indemnity
You agree to indemnify Amali London Ltd against reasonable losses or claims arising from your breach of these Terms or misuse of the site, except to the extent caused by our own breach or negligence.
18. Privacy
Your personal information is handled in accordance with our Privacy Policy, which explains what we collect, how we use it, and your rights (including under UK GDPR and, where relevant, New Zealand's Privacy Act 2020).
19. Force Majeure
We will not be liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including natural disasters, strikes, courier delays, or supply chain disruption.
20. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page, and changes will apply to orders placed after the update date.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, save that:
- if you are a consumer resident in New Zealand, nothing in this section limits your right to bring a claim under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 in the courts of New Zealand; and
- if you are a consumer resident elsewhere, you may also be entitled to bring proceedings in your local courts under mandatory local consumer protection law.
